Last year, the Winnipeg Construction Association had so many questions on drug and alcohol testing during our labour law and the construction industry session, they have decided to put together a full session on this topic. There will be a review of important court decisions as well as practical suggestions on how to deal with this difficult (and increasingly common) issue in the workplace.

  • The last, and largest, part of Manitoba’s new Condominium Act came into force on February 1, 2015. The new Condominium Act is a comprehensive rewrite of the old Condominium Act. The new Act is composed of over 300 sections, and the regulations comprise 53 sections plus multiple pages of schedules and forms. As well, the new Condominium Act has caused amendments within several other pieces of legislation.

  • Prior to the acquisition of a business, the purchaser will usually have an opportunity to carry out financial and legal due diligence on the business. This period of time is commonly known as the due diligence period and normally lasts from a few weeks to several months. During this period, the purchaser has an opportunity to “look under the hood” of the business being purchased, referred to here as the target, to review its legal and financial condition and determine whether there are any existing or pending issues.

The deal closed on February 26, 2016.

  • TDS lawyer Doug Forbes, along with associates Danny Spencer and Nicholas Woelcke acted for Glasshouse, an exciting new condominium development located across from the MTS Centre at 309 Hargrave Street in Winnipeg. Glasshouse is a 21 storey development featuring modern lofts, floor-to-ceiling windows, and exciting new amenities. Doug worked on the acquisition of the land, the preparation of the condominium documents, financing of the project and construction. Glasshouse is scheduled to be completed in the near future with occupancy starting in August, 2016.

When completed, the SkyCity tower will be Manitoba’s tallest building, and offer 30,000 square feet of amenities to residents. Doug and Nick are working on the preparation of condominium documents and providing sales support to the SkyCity sales team.
