Mental Health in the Workplace

Addressing mental health in the workplace requires a delicate balance of often competing interests. As society works to eliminate the stigma around mental illness and as the definition of “mental illness” continues to evolve, employers are regularly challenged to fulfill their obligations to accommodate employees up to the point of undue hardship while maintaining confidentiality, ensuring a safe and healthy workplace and fostering effective operations. To assist employers in fulfilling these obligations, Shandra Czarnecki will discuss the meaning of “mental illness”, the limits on employers’ right to medical information, the employee’s obligations in the accommodation process, the accommodation efforts employers must make and proactive measures they can take to avoid causing mental illness.
