TDS lawyers Kristin Kersey and Lisa Stiver, Lawyer will be speaking at the Winnipeg Construction Association course “COVID-19 Vaccinations in the Workplace and on the Jobsite” on Friday, October 22, 2021..

As COVID-19 vaccination policies are being developed in workplaces across the country, Kristin Kersey and Lisa Stiver from Thompson Dorfman Sweatman LLP, will discuss the evolving legal considerations and potential implications at the workplace, on jobsites and in the contracts. 

This 90-minute presentation will include the following topics:

  • Can an employer require workers to disclose their vaccination status?
  • Can an employer require a vaccination as a condition of employment? Can an employer discipline or terminate employees for refusing to be vaccinated?
  • What are some considerations when developing a vaccination policy?
  • Are there contract implications when a Project Owner requires mandatory vaccinations for all staff on the jobsite?  Is the Project Owner responsible for the added cost or delays if this requirement occurs mid-way through the project?
  • What if a General Contractor requires vaccinations but a Subcontractor cannot meet this requirement? 
  • Should all mandatory vaccinated sites / workplaces offer the option for COVID-19 tests for the unvaccinated?

While this is still a rapidly developing area of law, there will be reference  to decisions coming out of other jurisdictions and possible approaches employers can consider (or should avoid), based on the information currently available. This session will be interactive and questions will be encouraged.

Understanding the purpose and function of the Manitoba Builders’ Liens Act is an asset in the construction industry. Brush up on this topic as we discuss the types of construction activity which create lien rights, the process and procedure of registering a lien claim, enforcement of lien claims, the proper administration of holdbacks and a review of trust provisions arising under the Act. This session also includes a discussion on some of the most recent lien cases to come before the courts in Manitoba and across Canada.
